You are solely responsible for any information you provide and for all actions taken under your name, account, or communication channels.

If you purchase, transport, board, receive, or otherwise interact with livestock through our services, you acknowledge that livestock activities involve inherent risks, including injury, illness, escape, property damage, loss, or death of animals, and you assume responsibility for those risks to the fullest extent permitted by law.

4. Payment Terms and Conditions

Unless otherwise agreed in writing, all fees, charges, and costs are payable in Canadian dollars (CAD) and are due in accordance with the invoice or payment instructions issued by Dun Rite Stock and Stables Inc.

  • Prices may be quoted before applicable taxes, fees, or delivery/handling charges;
  • Applicable GST/HST, provincial taxes, or other charges may be added where required by law;
  • Payment methods may include electronic transfer, bank draft, credit card, cash, or other approved methods;
  • All payments must be made in full and without set-off, deduction, or withholding unless required by law;
  • Late or returned payments may incur reasonable administrative charges, interest, or collection costs to the extent permitted by law;
  • We may suspend services, refuse delivery, or delay performance if payment is overdue or incomplete.

Any deposit collected is non-interest-bearing unless otherwise required by law or expressly stated in writing. A deposit may be applied toward the final amount owing and may be forfeited under the cancellation terms set out below or where permitted by law.

If a pricing error occurs, we reserve the right to correct it and to cancel or modify the affected transaction subject to applicable law.

5. Cancellation and Refund Policy

Cancellations, rescheduling, and refunds, if any, are governed by the specific service agreement, invoice, or written arrangement between the parties. If no specific arrangement applies, the following general policy applies to the extent permitted by law:

  • Requests for cancellation must be made in writing using the contact information below;
  • Any non-refundable deposit, booking fee, or administrative fee may be retained to cover costs already incurred;
  • Refunds, if approved, will be issued only for amounts actually received by us and only after deducting applicable costs, expenses, and reasonable administrative charges;
  • No refund will be issued for services already performed, goods already delivered, or costs already incurred on your behalf;
  • Livestock transactions may be subject to special conditions due to animal welfare, transport, health certification, quarantine, and market conditions;
  • We may deny cancellation or refund requests where required by law or where performance has already substantially commenced.

If a livestock animal is rejected, delayed, or unavailable due to illness, biosecurity concerns, transport issues, regulatory restrictions, or force majeure, we will act reasonably and in good faith to offer a suitable remedy where possible, but we do not guarantee a refund in every case.

6. Liability Limitations

To the maximum extent permitted by applicable law, Dun Rite Stock and Stables Inc., its directors, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption, or reputational harm arising out of or relating to your use of the website or services.

To the maximum extent permitted by law, our total aggregate liability for any claim arising from or relating to the website or services shall not exceed the amount actually paid by you to Dun Rite Stock and Stables Inc. for the specific service giving rise to the claim, or CAD $100, whichever is greater, unless a higher limit is required by applicable law.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by negligence where such limitation is prohibited.
